Well if it's a dead ball foul as soon as the ball is snapped the whistle would blow. The play would never be run. What you say though is basically how it is now but it is sort of an unfair advantage to the defense if the clock is the biggest issue to the offense.

Now I totally think there are too may advantages for the offensive in the game currently but I am not sure this rule is good how it is.
