You are incorrect. Even if you include Joe Leiberman, the Dems had a filibuster proof majority in the Senate for only from July 7, 2009 - Feb 4, 2010. Plus, Congress was in session for just a little more than four months during this period.

Al Franken wasn't sworn in until July 7, 2010. Scott Brown, a Republican, filled Ted Kennedy's old seat on Feb 4, 2010.

The state should first raise the gas tax. In 1949, the gas tax was 6.5 cents/gallon which is about 60 cents in 2012 dollars. The current tax is 37.5 cents/gallon.

The legislature could phase the increase in over 5 years. They could then index the tax to inflation.
