get permit first before announcing the date, and be prepared with how to move the date if need be

I dunno, man. Maybe it's just cynical me but I doubt the gov would green light such a rally or if they were trying to make themselves look less authoritarian they could just make all sorts of excuses to delay a definitive answer.

So yeah, they definitely should have tried for a permit first, but sort of given past history I think the government did sort of force Bersih's hand as well.

this comes back to my questioning of Ambiga's belief that too little has been done in the time that has passed since the 2.0

That's a fair point but given that there's so much at stake, I don't think it's unreasonable to demand that much more should be done before the impending GE. The use of indelible ink has been the only thing that the EC has done so far as far as I know, but even that seems to be made inconsequential by the latest bills that have been passed in parliament (the stuff that Ambiga was talking about in the debate with Khairy).

But anyway, we're both clearly on opposite sides of the fence, and it's been great having this discussion but I don't think either of us will be changing each others minds anytime soon, and I have 3 assignments to complete :(

Cheers!

But if any applications made enforceable by the previous provisions were rejected then it'd be a as you said a deathknell to the rally.

If they had applied after the PAA came into operation, the application would have rejected outright since there just wasn't enough time to follow as stipulated by the act.

Whatever happens, it isn't impossible for Ambiga's Bersih to get a suitable date for a legal gathering, and Hishamuddian can only play that tactic once. Or they could have done the sensible thing and tried to get the permit first before announcing a date.

Well the thing is that everyone is speculating the elections will be in May or latest June, so yes they could have pushed it 30 days later, but by then it's likely that it would be election season already and what's to stop the gov from playing delaying tactics by rejecting but then saying "Well they could have appealed, but instead they went ahead anyway and had an illegal rally". And I don't think Ambiga could have simply move the date of the rally. The wheels were already set in motion, if they had move the date back, the amount of people would probably have been diminished.

I guess what I'm trying to say is that Hishammudin played a very strategic game. The Bersih committee was left with two choices: if they continued with the planned date, the gov can say "Well you didn't follow the rules etc." or if they had moved it to a later date, the number of people marching on the streets would be diminished or might be a moot point all together if the gov calls for election before the later date. Either way it's sort of a win-win for the Home Affairs Ministry. But that's just my opinion.

The first link is the gazette for the Act itself but not the notification of date of coming into operation, but the date of commencement list in the table is more likely changed after notification of commencement, drawing on the inference that none of the other acts that haven't come into operation yet have their date of operations listed.

Edit: Err the second link just brings me to the homepage.

has the dates of Agong's consent and of enforcement listed on the first page of the PDF

Date the Agong's consent yes, date of enforcement no. The second date is the date of publication in the Gazette which is 9/2/2012. Unless I'm reading it wrong from the fatigue.

The date was already set via the gazetting of the Act on the 9th of February

The date of operations was never stated in the document. It was stated that the date of operations is by appointment of the Minister

[–]jaslow 2 points3 points ago*

Sorry, don't take this the wrong way but could you show me where it says that PAA is slated to come into effect on 23/4?

The Federal Gazette published the notification that the act would come into effect on 23/4 only on 23/4. http://www.federalgazette.agc.gov.my/outputp/pub_20120423_Perhimpunan%20Aman_P.U.%20(B)%20147.pdf

Edit: Grammar :P

Edit2: Also,

no matter what Hishamuddin wants

seems fallacious as the bill states that it is by appointment of of the Home Affairs Minister

[–]jaslow 2 points3 points ago

The permit requires a 30 day notice though, so even if she plans for the protest to be held more than 30 days after she announces it, Hishammudin can just wait till it's past the 30 day notice period (which he did) to "activate" the bill and any attempts to legally apply for the protest would be moot.

Sorry if I'm not explaining this very well. I'm very tired.

[–]jaslow 4 points5 points ago

Doesn't the PAA only come into effect at the discretion of the Minister of Home Affairs? Which was only last Monday incidently. So I guess any date that they choose would be impossible to meet to procedures, but unlikely that it would be the Bersih committee's fault.

Counsellors to be trained to tackle LGBT by mooglehufferin malaysia

[–]jaslow 1 point2 points ago

Despite my disagreement with LGBT culture and behaviour, I recognise them as fellow humans, capable of rationalising their actions and making their own life choices. I personally find the idea of homosexuals being somehow enslaved to their genetically encoded behaviour and being unable to choose to not engage in homosexuality to be horrifying and demeaning. That, in my mind, is far more dehumanising, because you are basically saying that homosexuals are little more than animals who cannot help but act upon their lusts and instincts, and it's sad that such arguments come from LGBT supporters and activists who are trying to say that homosexuals are people too.

Please stop with the condescending attitude. It's one thing to air your disagreement with LGBTs but don't diminish sacrifices others have made by trying to sound holier than thou after comparing the vilification and marginalization LGBT people have face to something as shallow and superficial as

teenagers choose to emulate gangsta behaviour, or pretend to be emotionally fragile, or dress in black with white makeup

You say you recognize them as fellow humans, yet believe they should all just hole up and lie about themselves their entire lives. I'd ask you to try and do something along the same lines, but I'm not sure if there is something as fundamental and intristic to a persons being and identity as their sexuality or gender identity that you can lie about in a "walk in their shoes" social experiment.
