Spot-on advice.

Regardless of whether your child has an IEP or a 504 plan, the district is required to conduct a manifestation determination (MD) before they can move forward with the expulsion hearing. The evaluation is typically conducted by a school psychologist and the purpose of the evaluation is to answer two questions:

Was the conduct in question caused by, or substantially related to, the child’s disability? (Y/N) Was the conduct in question the direct result of the school’s failure to implement the student’s 504 plan? (Y/N)

If the answer to either of those questions is YES, then the district CANNOT expel your child.

If they have no intention of conducting the MD, then they are breaking federal law (IDEA).

If they do not conduct the MD, or if they do conduct the MD and your son is still expelled, you can contact the Office for Civil Rights (OCR) to file a complaint. Taking this action is a big deal- no district wants to face an OCR complaint.

Don't you feel like framing it?! ;) I left the church 2 years ago and after submitting my letter of resignation I received a similar letter in response. Our letters are the same in every way, minus the 'eternal consequences' line... Wow, talk about passive aggressive! Good for you for choosing your own path.

My husband teases me for this, but I always have to make visual contact of our two cats -outside of the dryer- before turning it on. I've never tumble dried a cat, but have heard too many stories. This thread has only reinforced my OCD, hahaa.

As someone who works in the public school system, my advice is to go to your school counselor, psych, or whomever you and/or her feel comfortable talking to. If she's telling you the truth, it's important for her to find someone to talk to. When I was 16, I was assaulted by a much older co-worker... felt enormous guilt... didn't feel like I could talk to anyone. My friend convinced me to talk to the school counselor, and she (the counselor) helped me to talk to my parents about it. Now, as a school psychologist myself, this sort of situation comes up far too often (and makes me mad as hell, frankly.) The important thing is for your friend to feel safe and to get the help that she needs.

Does thinking about the experiences that you had in the Mormon church ever make you angry? Defensive? I stopped attending the Mormon church when I was 17 but formally resigned two years ago, when I was 23. I hate that I still become defensive when asked to justify my leaving to friends or family. How do you dodge or address those kind of conversations?

That's exactly right. Once you've submitted your resignation letter they have to abide by it (they cannot require that you meet with the bishop to make it 'official').

Thanks! I'm not usually such a forceful writer, but I think at that point in my life I did not want there to be any way for them to misinterpret that I was 'done.' I've heard of situations where church members come to your door more often to make sure that you are serious about the decision.

I agree with cusscakes and rawrsauce. Regardless if you make the report yourself, it is a good idea to speak with a trusted teacher, school counselor, or school psychologist; however, school counselors and psychologists are bound to confidentiality laws that teachers are not. I am a school psychologist myself, and making reports to the Department of Child and Family Services is one of the most difficult aspects of the job. Sometimes, parents need help and do not know it until it arrives.

If you do choose to report, it makes it easier to fill this out beforehand. You will be asked about the different areas on the form:

You shouldn't have to handle this on your own, talk to someone. Good luck to you and your friend. :)
