Under Obama federal spending rose at slowest pace since Ike by wang-bangerin politics

[–]bobbyt2012 0 points1 point ago

Is the argument that the percent change in spending is less year to year and therefore he is spending less? I think this is kind of a load of BS because he increased spending drastically with the stimulus and then continued to spend that extra money in subsequent years. So what if he didn't increase spending as greatly as Bush did year to year. This analysis is totally irrelevant.

While I see what you're saying, Constitutional law always supersedes state and municipal law, so you can always use a Constitutional defense in court.

I agree wholeheartedly; however, by educating yourself about your civil rights, it is much easier to refuse such frivolous searches. Another thing people should do more often is to simply continue to say, "I do not consent to any searches," without actually preventing the police from entering their vehicle. If the police were to find something, it is inadmissible in court and can be withheld in a suppression hearing.

Let me add a little perspective first. When a cop pulls you over, it is essentially his/her job to collect enough evidence to convict you of something. They work in coordination with prosecutors, and prosecutors typically need evidence to convict someone of an offense. You may be aware of the phrase in the Miranda warning that reads "anything you say can and will be used against you in a court of law." It is important that you see that it only says AGAINST you. Evidence will never be provided that might be used for you.

So how does this relate to the 5th Amendment, you ask? The part that reads, "No person shall be held to answer for...nor shall be compelled in any criminal case to be a witness against himself," is the clause that would apply if you're being pulled over. Due to the 5th Amendment, you have no requirement to be a witness against yourself because you would be providing evidence that will be used against you.

For instance, suppose a police officer asks you how fast you were going in a speeding stop. If you know you were doing 15 over, but instead try to say you were only doing 5 over, not only have you just admitted to breaking the law, but you've also attempted to obstruct justice. Perhaps this was a bad example, but there are literally no scenarios where it pays to talk to the police.

This is why you never, ever give consent to searches. There is no reason to comply with the police -ever. You answer none of their questions - a right afforded to you under the 5th Amendment, and they cannot search your vehicle without reasonable suspicion - a 4th Amendment issue.

Also, giving law enforcement incentive to pull over out of state drivers is unconstitutional under the equal protections clause of the 14th Amendment.

I think 18 USC Chapter 115 should be rewritten to include this type of behavior. This is effectively a nonviolent overthrow of government through illegitimate means and therefore should be punishable as treason.

They should be designed to wear, not fail. The Bridgestone tires actually rubbered in the track instead of producing clag fields that inhibit the driver's abilities to pass.

A very misinformed comic. You don't need a super majority to pass a bill in the Senate and a cloture vote can be enacted to end a filibuster.

Looks grim to me. If you have to buy a PSL (Personal Seat License?) for a super high price, I would assume that each seat you wanted after that would be cheaper than the normal rate. So if $375 is the cheapest season ticket, I don't think it would be unreasonable to assume that the single seats will be more expensive, otherwise season ticket holders would be getting ripped off.
