French living in the same city as Rémi Gaillard, here.

Actually he has been sent to what we call "garde à vue" many times. The cops take you and you spend 24h in a cell while they check your Identity, drink coffes and basically make sure you wont do it again.

But when Rémi started his viedos, he was sponsorised by a french soda brand "Orangina" to make some viral funny videos of him ennoying people AND promoting Orangina See here and they now assume his acts and pay when he destroys things, the cops then dont really care and free him.

Now, many people know about Rémi's videos, so even if the cops legally have to bring him to "garde à vue" when he's doing something illegal or when he is ennoying people, some of them just laugh and let him go.

His videos are not for TV and dont come as a show, it stays on the internet, but sometimes, a french game or talk show invite him, maybe twice or three-times a year not more, to play, ask him a few question etc... Then eventually show some of his videos. It's still very uncommon and they usually pick only the more "correct" ones.

I believe that's all he has, otherwise i'm certain he would put it online. But you know, it's only him and his camera guy, so he cant really have multiple angles for his videos (even if sometimes he asks for people to help him Interfêtes (if you dont understand french, at the beginning of the videos, he calls the store to ask them if it was open and if it was a store "for partying".)

Once someone asked him why he wasnt using more props or people for his videos, and he said that he was the way he liked it and since he was alone he could do whatever he wanted and use a lot of improvisation.

French legal system is pretty different than US one:

  • your ability to defend yourself using lawyers is not correlated to your net worth.

  • lawyers are not allowed to advertise or to be paid on contingency fees.

  • court-appointed lawyer are pretty competent (they dont have the same reputation as US ones).

  • judges and public attorney are not elected and have no pressure to look repressive.

=> Being well off dont help much.

And yeah its much harder to end up in jail in France (ratio of ppl in jail / population is 4 times lower than in the US).

He surely spent many nights in cells but they can't put him in jail for that. Fines, sure. The thing is, if he wasn't famous a local judge might have sentenced him for a week or so, to teach him a lesson, but it would cause a public outcry so I don't think it was ever considered.

It's possible that the prosecutor can forego prosecution of small crimes if prosecution wouldn't be "in the public interest", i.e., if nobody really cared about a conviction and, although it was technically a crime, there was no real damage to society.

Such minor offenses in France ends up with a "rappel a la loi" ie, "remind the law". This means the prosecutor, though having grounds for prosecution, just reminds the offender of why what he or she did is unlawful.

After having done it umpteenth times, the prosecutor may feel obliged to prosecute.

I can think of assaulting a police officer for his butterfly video.

Assaulting an armed border patrol for his video where he threw a bunch of stuff into that camouflage vehicle with the guards in it.

I'm no expert, just saying what he would be charged with here in the US. Those are serious charges and there's video evidence against him.

Well, I'm pretty sure that if you steal a cop's hat in the states you'd end up in jail for a while or at least would get a serious fine. When this happens in France (Rémi did it), I imagine the judge going "Hmh, so.. he stole your hat? Did he give it back? Ok well, no harm, next case please".

Of course I don't live in France and I'm not even remotely close to being a lawyer or knowing anything about law. But I love to think I'm right.

One more thing: everything I know about american culture, law or way of life is taken from either reddit, Seinfeld, South Park or other TV shows and films. Basically I've got no idea what I'm talking about.

I'm trying to remember if he answered those questions to me - since he answered all the questions in French it was tough for me to edit it all together, ha.

I met him in a town square area in Montpellier - it was amazing how many people recognized him - when we bought a sandwich, the girl at the sandwich shop wanted his autograph. A man driving a garbage truck stopped to shake his hand. Dude is a real rock star, ESPECIALLY in his home town.

I believe he's unable to monetize a lot of his videos because they contain copyright music, but he should still make some money off of those within the partner program, just not all of them.

All in all, just a great guy - I was worried he was going to punk me, but he let me survive.

I live in Paris and actually he's not that popular. I mean almost every young people knows his stuff but older people rarely does. To be honest he's far from a national hero or being considered as French culture, i would say at very max 1 of 8 policemen would recognize him.

He never went to jail neither. However, he have been arrested few times (few hours at the police station) and even sentenced (for Outrage à agent as said below) to pay a fine.

The legal system is completely different in France. In France, the police force, and the justice system are national bodies that does not act upon the request of regional or local authorities. ("fonctions régaliennes de l'Etat" which could be badly translated as "sovereign functions")

Locally, the state is represented by a "Préfet" who personnifies the power of the French Government in a local perimiter called a "département". Local police forces take their orders from him.

France is not a federal country but a centralized one.

Remi, as far as I'm concerned is a part of the YouTube Partner Program so he has exclusive rights to put ads next to his videos upon which he receives money for each ad clicked through Google Adsense.
