Good god, I got caught about 3 years ago torrenting Norton Antivirus (some may say getting caught was well deserved). Anyways, ISP cuts off my internet (browser wouldn't go to any other page other than their anti-piracy one). I ended up having to talk to customer service where they instructed me on how to agree to "never illegally download".
And that's the day I switched over to DDLs.

I made the switch from torrents to DDLs about 2 years ago and boy am i happy.
The problem with torrents is if the thing you're looking for is not super popular, there own't be many seeders so you get a shitty speed.
With ddl theyre stored on servers forever (till they get deleteD).

Private trackers don't protect you from being monitored unless you personally know and trust every single user connected to it and its over a secure connection. The only thing private trackers do that is remotely useful is to help encourage users to seed fairly by limiting membership and banning users who don't maintain a reasonable ratio.

Just an FYI for those of you out there, if you're busted for pirating, they will send you a letter. They will not ask for a settlement or any form of payment directly. I got an incredibly infectious virus that forced me to completely reformat my old computer, but was an incredibly well-put-together scam as I found out.
Every time I would start up, Windows would go directly to a government warning page stating it had detected illegally downloaded content. I couldn't do anything else on my computer, it just stated that I had to A) Pay a $200 out-of-court settlement fee, or B) Face the investigation and face a lawsuit of up to $400,000 or something like that.
The problem is that it cites government agencies which have web-pages, a lawyer firm, the whole 9 yards. The thing is, they're all faked. It's one hell of a scam, because it first shows up as an anti-virus that scans your computer, and then cites different files even if you haven't actually torrented anything. It also doesn't go away if you pay the $200 according to the reports I found, it'll just pop up a month later.
Incredibly put together, but spread the word. If your ISP catches you, they'll send you a letter, and possibly shut off your internet. DO NOT pay if you're offered an option, as that is the indication of one of a whole set of very profitable scams.

"protection money" is nothing like the fake a/v economy - it's more like the REAL a/v economy, in that the gang will actually protect you if need be (and it suits them).
fake a/v is a huge market, to the point where they can afford to hire cold-callers to scam grandparents into manually installing it, but it's still a drop in the bucket with regards to organized cyber crime.

Happened to us in a completely different way but basically the same thing. They actually did a court order supena and everything (with about 4,000 names mind you) and then once they got everyones info sent out papers saying "we will offer an out of court settlement for $1,500, or $2,500 if you wait a month or $3,500 if you wait till right before we take you to court for the maximum of $400,000" contacted the lawyer that was handling the case, and the judge closed it from there. Gotta love legal extortion

I've had to deal with a similar virus. About a week ago my mom opened an e-mail from her spam folder and saw something important about FedEx with an attachment. she unfortunately downloaded it and opened it. It was some application she didn't understand so she closed it and the computer started to get bombed with error messages, Hard drive errors , pretty much any error you can think of. She clicked the fix button and it kinda helped. after it was done 'fixing' a window popped up saying she needed to buy some programs, supposedly By Windows, in order to fix her computer. Luckily she denied and turned it off until i got home. I was able to get it running again but all her files were deleted.

I worked in computer repair for a while and if there is one thing I have learned about viruses it is this:
If your computer has a virus...chances are the program saying you have the virus is the problem. Also, anytime you are randomly asked to pay monies without offering first, it is a scam.
I once saw a very similar thing, only it was "windows" claiming that it needed to confirm that you were running a legit version...the check required your credit card and bank pin numbers, lol.

There are more than 4 computers in my home of 4 people ( these 4 are connected to Internet all the time but we usually shut them down when we don't use. ) One day my wife took study leave and stay at home studying .. so she didn't switch on her computer. All computers except mine are off.
Somebody from US called my land line and told my wife that she want to talked to me .. about my computer is downloading illegal stuff. My wife called me with her mobile .. I did remote login to my computer and found out that my last download was completed 4 hours before. At that moment the indian lady keep saying my computer is still downloading and they are working with government agencies. I told my wife .. my download finished 4 hrs ago .. so there's nothing is downloading and told her to cut her loose.
Caller ( Indian woman ) keep insisting that my wife to goto a website and download security software. My wife is also from IT field .. so she said "I won't download anything from whatever website you've mentioned and if there is anything you want us to do .. call us after working hour." So the whole thing ended there.
I checked the caller ID and found out the caller is calling from US. I did further check and found out similar Indian man/lady with heavy Indian accent used to call like this and asked to install similar fishy tool then hijack the host computer. Then they will offer paid service to remove it. And will sell yearly plan to take care of your computer. They did called to international destination .. as far as to New Zealand.
I'm from Singapore. I do not use any torrent. I used paid service to download movies.

I was working for a councils IT department last week and they had received a call from a school telling them about a call that had been made to them. The caller told the school that they had a virus and the only way to fix it was to download a certified anti virus from Microsoft.
One of the IT guys phoned them up and they had an official sounding automated call system. He got through to an Indian guy and asked him how they had gotten the number. The guy refused to tell him so he stated that if he called any more schools he would report them for breaking the data protection act. Not sure what happened next.

You can hire a seedbox for anywhere from $10-$100 per month. Obviously the more you pay the more bandwidth you have on the box. I hired one for around $25 that had a maximum transfer of about 10MB/sec (megabytes per second)
The beauty of these is that you can download your torrents directly to the box at insane speeds, and then you FTP directly into the box to download them to your computer. This remove the chance of being tracked by another peer on the torrent that you have downloaded.
This also is a positive, as if you are using a ratio enforced private site, you will always be seeding and thus bumping your ratio up.

Yep, my seedbox is 300mbps up / down for $15 a month with a 1.5TB monthly limit. Even better, I control the speed I download from it. I rsync the files over at night and set the download speed to 1000kbps to avoid slowing the connection down for others that might be using it. I don't care if it takes 7 hours to download something.
Of course in the event that I want something in a hurry it will saturate my internet connection if I want it to.

I think I fit under the category of "IT savvy" it's my major, and I spent too much time in high school learning things about networking, and for the most part "beating the system". So here goes;
Look at your download mediums settings! uTorrent and BitTorrent both have this setting(or something similar) "Enable outgoing encryption" you should enable that... Switching up which port you use for torrenting also can't hurt. Anything you can do to put distance between yourself and your downloading activities, or to mask them is a good idea.
Knowledge is power. Although it can be dry, brushing up on some networking basics, and googling around for information on relevant topics can make you a better prepared redditor. If you understand what it is that you are doing, then you can apply advanced techniques to how you download.
Stay away from incredibly populated(top 100 etc.) torrents. What? Why? These are the torrents that firms are actively playing search and destroy with. You may have to wait longer to get what you want, but you will be a smaller target. Less populated torrents are smaller fish to fry, and subsequently, are less monitored.
Avoid downloading early. Same deal as above, you download early, your also painting a big 'ol target on your back.
SPACE OUT ALL THE THINGS! (like someone said before, spacing out ones downloads is a good idea. High volumes of illegal downloads within a few days or weeks is generally what gets people caught. I know some people from back in high school that got ISP warnings. Every one of them downloaded thousands of songs, or dozens of movies at a time. Those are big red flags. )
Proxy/Tor/VPN's Using these before/during your misadventures allow for increased levels of encryption/security, and in simple terms, make it harder for your ISP to tell what it is that you are doing on the internet at 3AM. IMO, Tor(www.torproject.org) is the best, but proxies and VPN's can be effective, wikipedia those if you'd like, although there are some free ones, good VPN's usually have a subscription fee. Plenty of free proxies abound, but like anything else, you tend to get what you pay for.

I've been in networking related jobs for over 10 years now. I've worked for major ISPs, and I handle DMCA notifications for clients at least a couple times a year in my current job. I have a few comments on your suggestions, based on my experiences.
Encryption
This used to help avoid throttling, but most major ISPs can detect it regardless if they want to by using more sophisticated methods. This does not help you avoid being caught for piracy. The host (MPAA/RIAA) can log the data being sent to you from their source, so it doesn't help in court.
Avoid downloading early.
I haven't found this to be very helpful. Many of the infringement notifications I've seen were for older, and sometimes very old movies. On public trackers they will monitor as many torrents as possible. Don't download illegal content directly from public trackers, period.
Space out all things
Downloading less will always reduce your likelihood of getting caught. ISPs aren't the ones who care about piracy, they just care how much bandwidth you use.
Proxy/TOR/VPN
If you are going to torrent, Proxies and TOR generally will provide very poor speeds, if they work at all. Also, the kind people hosting these exit nodes, proxies, etc may end up in legal trouble for what you're dong. Yes, not your problem, but kind of a dick move.
As some of the comments below suggest, get a seedbox. These companies understand the risk they are taking, and it's the business they chose to be in. Most of these companies are overseas and will not divulge your information, where as a proxy could potentially keep logs of your traffic to cover their own asses. In fact, most seedbox companies intentionally do not keep logs. Also, the speeds will be much better using one of these services. VPN can a good option as well, but usually more costly, and often not anonymous.

I realize that encryption probably won't fool an ISP/MPAA/RIAA if they're investigating you(Or if you've fallen victim to a trap...chances are if there's an investigation, they'll know everything and you're already euchred), but I'd like to ask of you whether something is better than nothing I guess?
Downloading early was something I noticed across the board of all my friends that got emails/letters from their respective ISP's. Just my personal experience, I admit I have no idea whether that contributed to getting them in trouble, but it was a pattern I noticed. This could be due to a lurking variable that they were the least savvy downloaders in the first place, but I don't know.
I liked your advice about public trackers, it bears repeating, DON'T USE PUBLIC TRACKERS EVER.
In response to your part about ISP's not caring about piracy. I agree with that, but getting flagged for bandwidth use could surely increase your risks of getting busted for piracy, if they look at your traffic more closely when you get flagged(bandwidth wise) they're bound to notice what you've been up to. Indirectly getting busted(getting busted because of loads of traffic) is still busted in my book.
I agree that speeds with proxies/Tor will suffer, that's a tradeoff.(I guess I have patience haha) Personally, of the methods mentioned, I stick to Tor.
Seedboxes work great(used to use one), although I would add that if you plan on using one/hosting one that you should do your homework on the company. Some places that offer hosting for dedi's and seedboxes claim to be "offshore" but aren't.

You are encrypting traffic between your client and the client you are connected to. The other side can obviously decrypt the traffic, or it wouldn't know what to upload, so it you connect to a client owned by RIAA/MPAA they know what you are trying to download from them.
Also, please don't use BitTorrent over Tor. The network has limited bandwidth, and pirating movies/music/whatever is not a good use of it. Chances are you are also doing it wrong like most people by talking to the tracker using Tor and downloading directly which doesn't help at all.

If they see bandwidth violation they'll cut your service or charge you extra. That's it. They don't care about piracy. They're not going through the extra work to "investigate your usage" and then figure out who the copyright holder is and then notify them and then get served with a DMCA notice and then pass it on to you. They're just going to take immediate action because you're downloading too much and it's costing them money. They already have a policy for how to deal with it. They will use the policy. The policy likely doesn't involve investigating piracy.

As someone who has been downloading pirated shit for 25 years and has yet to get even a warning, I can say #5 is untrue, My 15Mbps connection has been running full throttle for a couple years straight. No joke.
If they want to nab you, they can simply put a torrent on piratebay with them as a seeder and then capture all the leeches. Or join on to a torrent and see the other peers and get your info that way. Torrents are as stupid as Limewire or Kazaa. If you must torrent, don't download the latest hottest shit and you will avoid a vast majority of the crap. Private trackers aren't really any better, Demonoid invites are handed out like candy on 4chan and other places.....
Check out a program like NewsBin and go with usenet, many ISPs give you free access to basic newsgroups with a week or so retention. They tend not to advertise it because it is a known bandwith hog, but shit the shit hits the usenet groups just as fast as the torrent sites, and its waaaaaay safer because its a direct link between you and the usenet server (usually the ISP's) so the RIAA folks can't get in the act and catch your IP. There are also pay servers (I used to use Astraweb, ten bucks a month for a fast ass connection and they supposedly didn't keep any logs of who read what messages.....).
Don't use Tor for torrents, its not going to work like you hope. Tor is painfully slow. Most proxies will be terribly slow too. If you can't figure out usenet, direct downloads are you other safe(r) option.

The majority of people these days don't even know what Usenet newgroups are. Or how to use parity files, or how to UuEncode...and all the good stuff that comes along with newsgroups.
Luckily these days you don't have to - I use Easynews, and their web interface pretty much takes care of everything for you. By the time they're done, the files are ready to download, already joined, uudecoded, even unrarred. It's fantastic. I've been a member almost five years, and I'll probably be a member for five more.

I've actually been busted twice. One time was when I was living on-campus at university and the second was in an apartment. My IP is now flagged by EA for any subsequent downloading of their material and now Disney has it as well.
I've received two cease and desist orders and had to meet with a student affairs affiliate while living on-campus where I was notified of what I got caught downloading and given a warning for subsequent punishment, not excluding wireless restriction and probation.

last I checked.. I had something like 60 or so flags to my isp account for downloaded stuff.. I think they got tired of sending them to me because all I'd do is call up the isp and tell them I was unintentionally on an unsecured network that other people were using. Bought it easily enough..

Back in 2000 I was hosting a Hotline server with a bunch of movies out of my dorm room. I also had thrown a few mp3s on there. The RIAA sent a letter or something to the campus, they in turn left me some threatening phone calls to shut it off. Most of my friends have received letters in the mail at least a couple of times (Charter Communications in Los Angeles). It's basically a deal the MPAA worked out with the ISPs. I was caught torrenting, too. About 6 months ago? Maybe a little more. Not sure on the exact date. (Fucking Scott Pilgrim, made me get a strike for downloading that movie). Anyway, I've torrented since, my friends who are big torrenters and are more into computer stuff than I am told me I'd be fine. I believe them. You know how many people torrent daily? It's like getting arrested for Minor in Possession. Everyone drinks underage, it's just the few of them that actually get arrested for it out of the majority of them who actually don't get arrested for it and continue to drink underage and don't get caught. I torrent movies only though. And I don't do it all at once. I had a huge collection before, not anymore. I dropped my external drive right after I was caught torrenting movies. Clearly was a sign, although I don't believe in that bullcrap. Anyway, I think you'll be fine. It's been less than a year for me and I'm still torrenting.

The monthly cost of some are very cheap for the amount of data you can get. They have boxes on just about every country, so you can switch out from Moscow to Germany almost in the fly.
If someone looking to go after offenders sees connections out in Russia, I highly doubt they'd even waste the time trying to get user info through those channels, and if they do, the company will use the pain in the ass international rules to make it a losing battle.
